1. Who provides the service
Clearview Build Regs provides building regulations drawing services. Your written quotation and booking confirmation identify the legal service provider, business address, relevant registration details and contact details. These must be supplied before you accept a paid instruction. References to “we”, “us” and “our” mean that provider; “you” means the client named in the quotation.
Our office is at 3 Claridge Court, Lower Kings Road, Berkhamsted, Hertfordshire, HP4 2AF. For enquiries, contact studio@cbrplans.co.uk. Sending a quote enquiry is free and does not create a contract or instruct paid work.
2. Agreeing your instruction
Our quotation states the project address, proposed works, deliverables, fee, payment stages, timing, revision allowance and any building control support. It is valid for 14 calendar days unless it states another period. Website prices are starting prices; the project quotation fixes the agreed price.
We provide the quotation, these terms and the Cancellation Policy before you are asked to accept. The contract is formed when, after receiving your written acceptance, we send a booking confirmation accepting your instruction. We will confirm the contract date and, where applicable, the cancellation deadline. You may withdraw your proposed instruction without charge before we accept it. If we decline it, we refund any payment received.
The quotation, these terms, the Cancellation Policy and any expressly agreed changes form the contract. The quotation controls project-specific commercial details but cannot reduce your statutory rights. Information or assurances that are legally binding remain binding. Later changes require both parties’ agreement.
3. Our drawing service
We prepare the agreed building regulations drawings and construction notes for the stated project, normally from existing and proposed plans and other information you provide. We supply the agreed package as PDF files by email or an agreed download link. Editable drawing files, printed copies and additional formats are included only if stated in the quotation.
4. Services outside the standard drawing scope
Unless expressly included, the fee excludes measured surveys, site visits, planning applications, structural calculations and engineering design, specialist reports, statutory charges, Party Wall services, boundary or title advice, contract administration, construction supervision and certification of completed building work. We will identify known additional information or specialist input needed for the agreed drawings.
Excluding a specialist service does not remove our own duties as a designer or our obligation to prepare the agreed work properly. Higher-risk building work and other complex projects require separate assessment and are accepted only where we can competently provide the agreed service.
5. Standards and design roles
We carry out our services with reasonable care and skill, within our competence, and in accordance with applicable legal duties. The quotation confirms the UK country and applicable regulatory basis. Guidance for one country is not automatically suitable for another.
Before design starts, we clarify the project’s design responsibilities and any required principal designer appointment under building regulations and the Construction Design and Management Regulations 2015. Those are distinct roles. Our standard fee does not include a separately agreed principal designer service. However, a contractual label cannot exclude a role or duty that the law places on us because of the work we actually control or undertake.
We co-operate with the relevant designers and contractors and identify concerns affecting the agreed design. If we cannot competently fulfil a role needed for the project, we discuss suitable appointments and do not proceed on an inadequate arrangement.
6. Information you provide
Please provide the available existing and proposed plans, reliable dimensions, project address, proposed layout, relevant surveys, known site constraints and any planning, engineering or building control information. Tell us about all related alterations and any construction already undertaken. Supply information you are entitled to share and identify its source and any known limitations.
We assess information relevant to our work with reasonable care. Where accuracy is uncertain, we will ask for clarification, reliable measurements or a survey. A remote drawing service is not a measured survey. Concealed conditions may need site investigation. We remain responsible for errors we ought reasonably to identify; supplying information does not transfer all design risk to you.
7. Engineering and construction
Where engineering input is required, the quotation identifies who will obtain it and whether its cost is included. We incorporate the agreed engineer’s information and address relevant interfaces within our scope. Contractors should use the current issued drawings, verify site dimensions and report discrepancies before affected work proceeds. Changes to the agreed design should be referred to the relevant designer before construction.
8. Permissions and building control
The quotation states who submits to building control and what application support is included. You must arrange required permissions, appointments and inspections except where we expressly undertake an identified task. Approval is decided by the relevant authority or building control body. A drawing package is not permission to build, approval of workmanship or a completion certificate.
9. Fees and payment
Your quotation shows the total price, including VAT where applicable, and any separate charges. Unless the quotation states otherwise, 50% is payable after booking confirmation and before work starts. The remaining 50% is payable when the agreed review stage is complete and before final issue. Payment methods and amounts are confirmed in writing. Invoices are due within seven calendar days unless the quotation specifies a different period.
An advance payment is credited against the total fee. It is not automatically non-refundable. Cancellation charges and refunds are governed by the Cancellation Policy. If you dispute an invoice, tell us which amount and why so we can address it; statutory rights remain available.
We will not incur an additional fee, instruct a paid specialist on your behalf or increase the agreed scope without your express agreement to the service and price or pricing basis. Any approved external charges are identified separately. We do not apply a surcharge for choosing a lawful consumer payment method.
10. Starting and completing the work
We agree a realistic delivery date or period in the quotation and booking confirmation. The drawing period starts when the agreed payment and required information are received and we can lawfully start. If you have a consumer cancellation period, we wait until it ends unless you separately request an early start using the process in the Cancellation Policy. Paying or accepting the quote alone is not that request.
We tell you promptly if missing information, client changes, third-party delays or another material event affects delivery. We explain the impact, take reasonable steps to reduce delay and agree an updated date where needed. Delay does not give us an automatic right to increase the fee or remove your rights if we fail to deliver as agreed.
11. Client changes and included revisions
The quotation defines the number and scope of included client revisions, any response period and the building control query support. Please send comments together where possible. A new layout, additional works, changed engineering information or a materially different brief may require extra work. We explain the proposed additional fee and timing and obtain written agreement before undertaking it.
We correct our own errors or omissions in the agreed service without an extra fee. Necessary correction of our work is not a chargeable client revision. Expiry of an included support period does not remove your rights concerning defective services.
12. Building control queries
We respond to queries covered by the agreed package and support allowance. Where a query identifies a defect in our agreed work, we address it without an additional fee. New work or specialist information outside that scope is discussed and priced separately before instruction. We do not promise an approval date controlled by a third party.
13. Pausing work
If an undisputed payment is overdue or essential information is missing, we explain the issue in writing and allow at least seven calendar days to resolve it before pausing affected work. We may pause sooner where continuing would be unlawful or create a material safety risk, explaining why promptly. We discuss the revised timetable when the issue is resolved. A pause is not an automatic cancellation or forfeiture of payments.
14. Drawing issue and permitted use
We identify the issue status and revision of each drawing package. Draft or incomplete drawings must not be used for construction. Use the current final issue with the relevant engineering information and approvals. If the project changes, the affected details must be reviewed before they are used.
We retain copyright in original work we create. You may share supplied drawings with your appointed advisers, building control and contractors for this project. Once paid for, the agreed deliverables may be used to complete, maintain and repair the stated project, including by a replacement professional. Reuse at another property or resale requires our written agreement. This clause does not restrict your statutory rights or use of documents needed to pursue a complaint.
15. Cancelling or ending the instruction
Our separate Cancellation Policy is part of this contract. It explains consumer cooling-off rights, early starts, cancellation at other times, proportional charges and refunds. You may end an unfinished instruction using that policy. We do not charge for unperformed services merely because the project is cancelled.
If you materially breach the contract, we explain the breach and give at least fourteen calendar days to put it right before ending the instruction, unless continuing would be unlawful or unsafe. If we cannot deliver, we discuss a suitable alternative or end the affected services and refund payments for work not supplied. We provide an account and appropriate handover, including any handover required by our statutory role. Your rights arising from our breach remain unaffected.
16. Responsibility and remedies
We are responsible for loss caused by our breach of contract or negligence in accordance with applicable law. We do not exclude or restrict liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any liability which cannot lawfully be excluded or restricted. These terms do not impose a liability cap based on the drawing fee.
Consumer rights include the right to services performed with reasonable care and skill and, where the law provides, repeat performance or a price reduction. Other available remedies are preserved. A statement about a limited drawing scope does not remove responsibility for the quality of that agreed service.
17. Privacy and confidentiality
The quote form prepares an email on your device. Its answers are not submitted to a website database. You choose whether to send them to studio@cbrplans.co.uk and which drawings to attach. We use information you email to review your enquiry, prepare a quotation and, if instructed, deliver the agreed service and maintain necessary business records.
Before a paid booking, we provide the legal provider’s details and information about its handling of personal data. Please ask us by email if you have a question about your enquiry information. Do not include bank details, identity documents or unrelated sensitive information in your enquiry.
We do not publish your name, address, photographs or identifiable project drawings as marketing material without your permission. Acceptance of these terms is not consent to marketing or publication.
18. Complaints and disputes
Send complaints to studio@cbrplans.co.uk or the complaints postal address supplied in your booking, identifying your project and concern. We aim to acknowledge within five working days and give a substantive response within fifteen working days, or explain what further investigation is needed. We provide any legally required information about appropriate alternative dispute resolution at the relevant stage. You are not required to use mediation or arbitration before exercising your court rights.
19. Governing law and communication
English and Welsh law governs the contract. If you are a consumer, this does not remove mandatory protection under the law of your UK home country or your right to bring proceedings in the courts available to you there. For business clients, the courts of England and Wales have jurisdiction. We normally communicate by email, and either party may give written notices to the addresses identified in the booking. The Cancellation Policy also permits any other clear cancellation statement allowed by law.
We do not amend an existing contract merely by changing our website terms. If a term is unenforceable, the other terms continue so far as the law permits. This does not allow us to rewrite a term to your disadvantage.
Your written quotation confirms the project-specific arrangements. Read our cancellation policy before accepting an instruction. We supply the accepted documents in a form you can keep.
